New legislation will prohibit jurors accepting intoxication as reasonable evidence of sexual assault

Legislation will be passed in Queensland today to prohibit jurors from accepting evidence of sexual assault victims being drunk or intoxicated as a reasonable explaination for perceived consent.

Last year, the Queensland Law Reform Commission conducted a review of the definition of consent in state legislation and made recommendations to amend the consent and mistake of fact criminal code.
