Four-year-old Tharnicaa and her family from Biloela will make a last ditch attempt to get a visa to stay in the country, as she learns today whether Australia’s highest court will hear her case. 

Tharnicaa was discharged from a Perth hospital in June after being medically evacuated from Christmas immigration detention where the family was held for three years as they fought deportation to Sri Lanka.

Tharnicaa is fighting a law that states she can not even apply for a visa, unless the minister exercises his discretion to allow it. Her lawyers are hoping to convince the High Court that she does have a valid visa application already in play.
